1. Agreement to these terms
By accessing or using eSomme (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be legally able to enter into this agreement where you live.
2. Eligibility and responsible use
The Service is intended only for adults of legal drinking age. eSomme does not sell alcohol. You are responsible for following local laws and for consuming alcohol responsibly. Do not use the Service while driving or in any situation that requires your full attention.
3. Your account
You are responsible for keeping your sign-in credentials secure and for activity under your account. Provide accurate information and promptly notify us at support@esomme.comif you believe your account has been compromised.
4. The Service
eSomme helps you record wine experiences and may provide personalized or AI-assisted information. We may add, change, suspend, or discontinue features. We will provide notice when reasonably practical if a material change affects your use of the Service.
5. Recommendations and AI-generated content
Recommendations, pairings, wine details, and AI-generated results are provided for general informational and entertainment purposes. They may be incomplete, outdated, or inaccurate and are not professional, medical, safety, investment, or purchasing advice. Labels, allergens, availability, pricing, vintage details, and alcohol content should be verified with the producer, seller, or another authoritative source.
6. Your content
You retain ownership of tasting notes, ratings, photos, and other content you submit (“Your Content”). You grant eSomme a limited, nonexclusive, worldwide license to host, copy, process, and display Your Content only as needed to operate, secure, and improve the Service and provide the features you request. This license ends when Your Content is deleted, subject to reasonable backup and legal-retention periods.
You represent that you have the rights needed to submit Your Content and that it does not violate law, privacy, intellectual-property rights, or these terms.
7. Acceptable use
You may not:
- use the Service for unlawful, fraudulent, or abusive activity;
- interfere with or attempt to bypass security or access controls;
- scrape, reverse engineer, or copy the Service except where law permits;
- upload malicious code or content that infringes another person's rights;
- use automated means to access the Service without written permission; or
- misrepresent eSomme output as verified expert or safety advice.
8. Intellectual property
The Service, including its software, design, branding, and content other than Your Content, belongs to eSomme or its licensors and is protected by intellectual-property laws. These terms do not transfer ownership to you.
9. App Store terms
If you download eSomme through Apple's App Store, Apple's Standard End User License Agreement applies to the license for the app unless eSomme provides a valid custom license agreement. Apple is not responsible for maintaining or supporting eSomme, and your use of the App Store is also subject to Apple's terms.
10. Third-party services
The Service may rely on or link to third-party services. Their own terms and privacy policies apply to their services. eSomme is not responsible for third-party content or services outside our control.
11. Termination and account deletion
You may stop using the Service at any time and may delete your account through the app. We may suspend or terminate access when reasonably necessary to protect users, comply with law, address security risks, or respond to a material breach of these terms. Where appropriate, we will provide notice and an opportunity to appeal.
12. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and noninfringement. Nothing in these terms limits rights that cannot be waived under applicable law.
13. Limitation of liability
To the extent permitted by law, eSomme and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Service. Any limitation applies only to the maximum extent allowed where you live.
14. Changes to these terms
We may update these terms as the Service changes. We will post the updated terms and revise the effective date. If a change is material, we will provide additional notice when required. Continued use after updated terms take effect means you accept them.
